for Creative Pool & Promotion by Andrea Heberger e.Kfr. · As of September 2026

These general terms and conditions apply to membership in the Creative Pool & Promotion of Andrea Heberger e.Kfr.
The offer is directed exclusively at entrepreneurs within the meaning of § 14 of the German Civil Code (BGB) who, when entering into the contract, are acting in the exercise of their commercial or self-employed professional activity.
Under the name Creative Pool & Promotion, Andrea Heberger e.Kfr. offers a presentation platform with a promotion service for selected artists in the fields of photography, motion and digital art, on the basis of a six-month or twelve-month membership.
Depending on the package booked, the service comprises promotion, support and guidance.
This includes in particular the member's presence with their portfolio on www.andreaheberger.de, the distribution of the member's content via further platforms such as GoSee and Inpholio including their newsletter services, the distribution of news through Andrea Heberger's database, and the publication of content on social media, in particular Instagram.
The scope and frequency of the individual services depend on the package booked.
Where content is published and distributed via external platforms and social media, the terms and conditions and the technical requirements of the respective platform operators apply in addition.
By submitting images, film or other material, the member confirms that they hold the rights required for the agreed publications and that they are not infringing the rights of third parties.
The member indemnifies Andrea Heberger against claims by third parties asserted on the basis of an infringement of these rights for which the member is responsible.
Andrea Heberger accepts no liability for incorrect or incomplete information provided by the member, nor for incorrect information or technical faults of external platforms such as GoSee and Inpholio.
Continuous and uninterrupted availability of the website www.andreaheberger.de and of external platforms cannot be guaranteed.
The membership is agreed for a fixed period of six or twelve months.
The minimum term is six months.
The membership does not renew automatically and ends when the agreed membership period expires.
For a booking of twelve months, a discount of 10 % is granted on the regular price of two consecutive six-month membership periods.
The membership fee is payable in advance. The invoice is issued as soon as the member's portfolio is online on www.andreaheberger.de. The membership begins at that point.
The amount of the membership fee and the scope of services depend on the package booked.
In the case of a membership with a term of six months, ordinary termination during the term is excluded. The membership ends automatically after six months.
In the case of a membership booked for twelve months, the membership may be terminated early for the first time with effect from the end of the sixth complete membership month. Notice of termination must reach Andrea Heberger in text form no later than 30 days before that date.
In the event of such an early termination, the 10 % discount granted for the annual booking no longer applies. For the first six months, the regular price of the six-month package booked is charged. Any amount already paid in advance beyond that is refunded.
If the twelve-month membership is not terminated with effect from the end of the sixth membership month, it continues until the end of the agreed twelve-month membership period and then ends automatically.
The right of both parties to terminate for good cause remains unaffected.
Any early termination or refund beyond this may be agreed as a gesture of goodwill in individual cases. There is no entitlement to this.
Andrea Heberger reserves the right, in the event of late payment, to suspend the services and to suspend the membership until payment has been received in full.
The use of a member's images, film or other material for Andrea Heberger's own promotional purposes takes place only in agreement with the respective member or the rights holders.
In publications, Andrea Heberger names the member and the web address requested by the member, or the contact details of their representation, so that interested parties can approach the member or their representation directly.
Enquiries that reach Andrea Heberger in connection with a member's work are forwarded to the member promptly.
The membership does not include taking on production or organisational services for shoots, filming, cost estimates or comparable services, unless these have been expressly agreed separately.
By entering into the membership, the member agrees that the professional data required for the presentation, in particular name, location, web address and professional contact details, will be published and made internationally accessible within the scope of the agreed promotion service.
In all other respects, personal data is processed in accordance with the privacy policy of Andrea Heberger e.Kfr.
The law of the Federal Republic of Germany applies.
To the extent permitted by law, the place of jurisdiction is Neu-Anspach, Germany.
